Asst District Attorney- Brian Crocker                                              Baliff- Off. T.D. Foster

Police Officer(s) Present: Dan Kellough; Greg Martin

Charges-  Felony - Violation of Probation

Ruling-  Case Continued until 6/30/09

Notes- It was explained to us by the ADA prior to Mr Johnson's case being heard, because of the way he was sentenced previously, the most severe penalty is, once again, more supervised probation. Upon the case being presented before the judge, Mr Johnson requested a continuance.  He did not have his attorney that he hired( Mr. Keith Stroud) present in court room.  The public defender, Judy Blevins, said she was not prepared to represent Mr Johnson and he should be able to have his own personal attorney who is familiar with the case represent him on another day.  The judge expressed that he could not rule that Mr Johnson violated his probation until he was proven guilty on new charges. The Judge also said that he wasn't trying to duck the issue but he had a full calender for the afternoon session and didn't feel that he had time to hear the case.(This comment was made approx.10:20 in the a.m.) Brian Crocker (ADA) stressed that they had evidence showing that Mr Johnson did in fact possess drugs and that was in direct violation of his probation.  There were 2 officers in the court room to attest to this fact and had video to prove this. The Judge felt it was best to continue this case until a later date.
